01Who We Are
ActionScale is a marketing agency owned and operated by Mark Savin, based in Scottsdale, Arizona. We provide lead generation, paid advertising, web design, local SEO, automation, and growth consulting to service businesses across the United States.
This Privacy Policy applies to actionscalenow.com, our subdomains, and any service you receive from us (collectively, the "Services").
02What Information We Collect
We collect information in three ways: what you give us, what we collect automatically, and what we receive from third parties.
Information you give us
- Contact details: name, email, phone number, business name, website URL, industry, location.
- Communications: emails, text messages, voicemails, and the content of any forms you submit.
- Audit & onboarding inputs: Google Business Profile URL, ad account access, CRM logins, billing details — only when you provide them as part of an active engagement.
- Payment information: processed by our third-party payment processor (Stripe). We never see or store your full card number.
Information we collect automatically
- Usage data: pages visited, time on page, referring site, search terms used to find us.
- Device data: IP address, browser type, operating system, screen size, approximate location (city/state derived from IP).
- Bot interactions: the website you submit to our AI auditor and the audit results returned, which are stored to improve the tool.
Information from third parties
- Public website data (your homepage HTML, page speed, schema markup) when you submit a URL for audit.
- Public Google Business Profile and Google Maps data when relevant to your audit.
- Search engine results (SERP data) showing competitors in your area.
03How We Use Your Information
We use your information to:
- Respond to your inquiries and deliver the services you've requested.
- Run audits, build campaigns, and produce reports.
- Process payments and manage billing.
- Send service-related emails (campaign reports, status updates, performance summaries).
- Improve our website, our AI tools, and our internal processes.
- Comply with legal obligations, prevent fraud, and protect our rights.
- Send occasional marketing emails — only if you opted in. You can unsubscribe at any time.
06AI Tools & Chat Transcripts
Our website includes an AI-powered audit tool ("Mark, the AI Growth Advisor"). When you interact with it:
- We send your inputs (your website URL, business type, location, questions) to Anthropic's Claude API to generate the response.
- We may store the conversation transcript and audit output to improve the tool.
- Anthropic does not use API inputs to train its general models, per its current terms.
- The AI does not provide professional advice. Output is informational and based on publicly available data.
If you don't want your conversation stored, don't submit it.
07Data Retention
We keep your information only as long as we need it:
- Inquiry-only contacts: up to 24 months from last contact, then deleted.
- Active clients: retained for the life of the engagement plus 7 years for tax and accounting records.
- AI audit transcripts: up to 12 months.
- Marketing email lists: until you unsubscribe.
08Your Rights
Depending on where you live, you may have the right to:
- Request a copy of the information we hold about you.
- Correct information that's inaccurate.
- Request deletion of your information ("right to be forgotten").
- Opt out of marketing emails or the sale/sharing of personal information.
- Restrict or object to certain processing.
California residents have specific rights under the California Consumer Privacy Act (CCPA/CPRA), including the right to know what we collect, to delete it, to correct it, and to opt out of "sale" or "sharing" — though we don't sell personal information.

09How We Protect It
We use reasonable administrative, technical, and physical safeguards including:
- HTTPS/TLS encryption for all site traffic.
- Two-factor authentication on all admin accounts.
- Access controls — only Mark and explicitly authorized contractors can see client data.
- Encrypted backups stored with reputable cloud providers.
No method of transmission or storage is 100% secure. If a breach affecting your data ever occurs, we'll notify you and the appropriate authorities as required by law.
10Children's Privacy
Our Services are intended for business owners aged 18 and older. We do not knowingly collect information from anyone under 18. If you believe a minor has submitted information, please contact us and we'll delete it.
11Changes to This Policy
We may update this Privacy Policy from time to time. The "Last updated" date at the top tells you when it was last changed. Material changes will be flagged at the top of the page or sent by email to active clients. Continued use of the Services after changes means you accept the updated policy.
